These Terms and Conditions (“Terms”) apply to your use of divineseairlogistics.com (the “Website”) and to enquiries and quotations you request through it. The Website is operated by DivineSeair Logistics Pvt. Ltd. (“DivineSeair Logistics”, “we”, “us” or “our”). By using the Website, you agree to these Terms. If you do not agree, please do not use the Website.

Use of this website

You may use the Website for lawful business purposes only. You must not:

• use the Website in any way that is unlawful, or submit information that is false or misleading;
• try to gain unauthorised access to the Website or our systems, or interfere with or disrupt them;
• introduce viruses or other malicious code;
• copy, scrape or harvest content or contact details from the Website by automated means without our written permission; or
• submit an enquiry on behalf of another person or company without their authority.

Our services

DivineSeair Logistics provides freight forwarding and logistics services, including air freight, sea freight, FCL and LCL shipping, break bulk and project cargo, oversized and out-of-gauge cargo, customs clearance, multimodal transportation, and trade show and event logistics. Descriptions of our services on the Website are for general information only.

Quotations and bookings

A quotation is an estimate based on the information you give us, such as the origin, destination, cargo type, weight, dimensions, quantity and shipping date. Please note that:

• a quotation is not a confirmed booking until we confirm it in writing;
• rates and transit times can change because of carrier or airline rate changes, surcharges, exchange rates, fuel costs, port or airport charges, customs requirements, or differences between the cargo declared and the cargo actually shipped;
• transit times are estimates and are not guaranteed, as they depend on carriers, weather, congestion, inspections and customs processing; and
• unless a quotation says otherwise, it does not include customs duties, taxes, inspection or examination charges, storage, demurrage or detention.

Each shipment is also subject to the written quotation, booking confirmation and any separate service agreement we make with you. If any of these conflict with these Terms, they apply to that shipment.

Your responsibilities

When you ask us to quote or handle a shipment, you must:

• give us complete and accurate information about the cargo, including its description, quantity, weight, dimensions, value, and whether it is dangerous or restricted;
• provide correct and complete documents on time, such as the commercial invoice, packing list, licences and certificates;
• pack, mark and label the cargo properly for the mode of transport;
• make sure the cargo is lawful to export, transport and import, and does not include prohibited or restricted goods; and
• pay charges, duties and taxes as agreed.

You are responsible for the consequences of incorrect, incomplete or late information or documents, including delays, fines, storage and additional charges.

Customs and regulatory compliance

Customs clearance depends on the accuracy of your documents and on the decisions of customs and other authorities. We coordinate clearance on your instructions, but we cannot control inspections, assessments or processing times. Duties, taxes and penalties imposed by authorities remain your responsibility unless we agree otherwise in writing.

Carriers and third parties

We arrange transport and related services with airlines, shipping lines, truckers, rail operators, warehouses and other partners. Their own terms, such as the bill of lading or air waybill, also apply to your cargo. We are not responsible for the acts, delays or failures of third parties, except where the law or our written agreement with you says otherwise.

Cargo insurance

We recommend that you insure your cargo for its full value. A carrier’s liability is usually limited by its contract terms and by the rules that apply, and may be well below the value of your goods. Unless we arrange insurance for you in writing, your cargo is not insured by us.

Limitation of liability

To the extent the law allows:

• we are not liable for indirect or consequential loss, such as loss of profit, business or goodwill;
• we are not liable for delay, loss or damage caused by events outside our reasonable control, by inaccurate or incomplete information from you, by the nature or inherent defect of the goods, or by the acts of authorities or carriers; and
• our liability for any shipment is limited as set out in the booking confirmation or service agreement for that shipment.

Nothing in these Terms excludes or limits any liability that cannot be excluded or limited by law.

Events beyond our control

We are not responsible for any failure or delay in carrying out our obligations that is caused by events beyond our reasonable control. These include natural disasters, severe weather, war or civil unrest, strikes, port or airport congestion or closure, pandemics, government action, sanctions, and carrier or system failures.

Website content

The information on the Website is provided for general information and on an “as is” basis. We try to keep it accurate and up to date, but we do not guarantee that it is complete or error-free, and it is not legal, customs, tax or other professional advice. We may change or remove content at any time, and the Website may be unavailable from time to time.

Intellectual property

The content of the Website, including its text, graphics, logos, images and layout, belongs to DivineSeair Logistics or its licensors and is protected by intellectual property laws.
